HL Deb 20 July 1971 vol 322 cc852-3

[References are to Bill 141 as first printed for the Commons]

[No. 1]

Clause 5, page 2, line 39, after "made" insert "(whether expressly or by implication)".

THE LORD CHANCELLOR

My Lords, I beg to move that this House doth agree with the Commons in their Amendment No. 1. These Amendments are all to be accepted, if the House agrees. Amendment No. 1 is basically drafting. It was inserted in another place to meet a criticism by a member of the Opposition, and the Law Officers thought that it made matters plainer and accepted it. I ask the House to do the same.

Moved, That this House doth agree with the Commons in the said Amendment.—(The Lord Chancellor.)

LORD GARDINER

My Lords, I have read the Report of the proceedings in the other place, and it appears to me that both this and all the other Amendments to the Bill are in the nature of drafting improvements. I hope that the House will accept them. With regard to the noble and learned Lord's recent observations, may I respectfully congratulate both the Law Commission and the noble and learned Lord on the amount of law reform that he has got through this Session. I cannot, unhappily, say the same of those fields for which the noble and learned Lord the Lord Chancellor is not responsible, such as the Department of Trade and Industry; but so far as the noble and learned Lord the Lord Chancellor is responsible for certain branches of our law, I respectfully congratulate him on the amount of law reform he has got through this Session.

THE LORD CHANCELLOR

My Lords, I am immensely grateful to the noble and learned Lord for saying that. I owe a great deal in this Session to the preliminary work which he did, and I have already acknowledged my indebtedness.

On Question, Motion agreed to.
