HL Deb 02 February 1971 vol 314 c1140

3.50 p.m.

THE LORD CHANCELLOR

My Lords, I beg to move that this Report be now received.

Moved, That the Report be now received.—(The Lord Chancellor.)

On Question, Motion agreed to.

Clause 7 [Compliance with order by employer]:

THE LORD CHANCELLOR moved, in subsection (4) to leave out "one shilling" and insert "five new pence". The noble and learned Lord said: My Lords, perhaps I may be allowed to explain both the Amendments on the Paper. They are entirely consequential on the fact which now appears, that the Bill will not pass until after the day on which the Decimal Currency Act 1969 comes into force. Clause 7(4) of the Bill enables an employer, when making a deduction from a debtor's earnings in order to comply with an attachment of earnings order to deduct one shilling or such other sum as may be prescribed by order made by the Lord Chancellor towards his clerical and administrative costs". Provision is also made for converting the reference to one shilling into a reference to five new pence on and after the appointed day for the purposes of the Act of 1969. As it is now clear that this Bill will not pass until after that day, the reference to a sum of money in the old currency and its conversion into the new can be dispensed with. My Lords, I beg to move the first Amendment.

On Question, Amendment agreed to.

THE LORD CHANCELLOR

My Lords, I beg to move the second Amendment which stands in my name.

Amendment moved— Page 7, leave out lines 13 to 16.—(The Lord Chancellor.)

On Question, Amendment agreed to.
