Clause 5, page 5, line 4, at end insert—
( ) any physical or mental disability of either of the parties to the marriage;
line 27, at end insert—
( ) any physical or mental disability of the child".
§ THE LORD CHANCELLORMy Lords, if no noble Lord objects I will take Amendments Nos. 2 and 3 together. These linked Amendments specify physical or mental disability of a spouse or a child of the family as matters to which the court must have regard when considering an order for financial provision. I should have thought it was clear (and it was our original view) that a court should have regard to such a factor wherever it was present. The Opposition took the view that it would be more satisfactory that it should be stated in the Bill, and the Government have accepted that. I beg to move that this House doth agree with the Commons in their Amendments Nos. 2 and 3.
