HL Deb 19 May 1970 vol 310 c1028

[No. 42]

Clause 38, page 29, line 29, at end insert: ( ) Nothing in this section applies to a legal aid contribution order made before the day appointed under section 47 of this Act for the coming into force of this section; and in relation to such an order the enactments in force immediately before that day and relating to the enforcement of such an order shall continue to apply notwithstanding any repeal effected by this Act, without prejudice however to section 10(6) of this Act.

THE LORD CHANCELLOR

My Lords, I beg to move that this House doth agree with the Commons in their Amendment No. 42. This Amendment is a transitional provision relating to cases where a legal aid contribution order is made, but not enforced, before the day appointed for Clause 38 to come into force. Such orders will continue to be enforced under the present law under Section 79 of the Criminal Justice Act 1967. I beg to move.

Moved, That this House doth agree with the Commons in the said Amendment.—[The Lord Chancellor.)

On Question, Motion agreed to.
