HL Deb 19 May 1970 vol 310 cc1015-6

[Nos. 29 and 30]

Clause 23, page 20, line 10, leave out from beginning to "shall"

Clause 23, page 20, line 16, at end insert—

"(3) In section 1 of the Act of 1958 (introductory provisions setting out the scheme of Part I as respects registration in one court of a maintenance order made by another), after subsection (1) there shall be inserted the following subsection:— '(1A) In the following provisions of this Act "maintenance order" means any order specified in Schedule 8 to the Administration of Justice Act 1970'".

4.55 p.m.

THE LORD CHANCELLOR

My Lords, if no noble Lord objects I will move that this House doth agree with the Commons in their Amendments Nos. 29 and 30. I believe that in error they are listed in the printed document as under Clause 22, when it should be Clause 23. These Amendments are related to the intention to introduce a Bill to consolidate all provisions relating to attachment of earnings. Section 21(1) of the Maintenance Orders Act 1958 contains the definition of "maintenance order". I could then give your Lordships, and will give your Lordships, the reasons, if required, why these particular Amendments are necessary, or at least desirable, as they help towards the Bill to consolidate all provisions relating to attachment of earnings. Otherwise, I beg to move.

Moved, That this House doth agree with the Commons in the said Amendments.—[The Lord Chancellor.)

VISCOUNT COLVILLE OF CULROSS

My Lords, I hope the House will not ask the noble and learned Lord to read out the explanation. It seems to me to be technical, and highly desirable, as is anything which goes towards consolidation. Perhaps I should have said before that it was on the consolidation measure that we should write a book, and not on this Bill.

On Question, Motion agreed to.
