THE EARL OF LISTOWEL

My Lords, I beg to move the first Amendment on the short list of Amendments. As this Amendment is consequential on the following Amendment I should like, with the leave of the House, to explain what the second Amendment sets out to do. Certain provisions conferring protection on statutory undertakings were, by inadvertence, deleted during the Committee stage of the Bill. The purpose of the second Amendment, which of course has been agreed by the Promoters, is to restore these protective provisions to the Bill, and therefore to give the statutory undertakers the safeguards they require. I beg to move the first Amendment, at page 5, line 18 of the Bill.

My Lords, I beg to move the second Amendment.

Page 5, line 19, at end insert— ('(ii) in subsection (2) after the word "subsection" there were inserted the words "or to exercise any powers conferred by Part II of the Flintshire County Council Act 1970 which will or may affect any apparatus" and before the words "the undertakers may" there were inserted the words "in any case where the local authority intend to remove or alter any apparatus"; and (iii) in subsection (4) after the words "by reason of" there were inserted the words "the exercise of any powers conferred by Part II of the Flintshire County Council Act 1970 in respect of any land purchased under the said Part II or".').—The Earl of Listowel.)
