Clause 95, page 129, line 45, at end insert— Provided that the appointed day for the purposes of section 95 of this Act shall not precede the appointed day of section 96 of this Act.

The Commons disagreed to this Amendment for the following Reason:

Because it would produce undesirable inflexibility in the reduction of permitted driving time and working hours for drivers.

My Lords, I beg to move that this House doth not insist on its Amendment No. 80 to which the Commons have disagreed. This Amendment would have had the effect of preventing any reduction of drivers' hours until tachographs have been introduced into the cabs of lorries and public service vehicles. But I emphasise that, as I have said before, there will be full discussion with both sides of industry on the question of when tachographs shall be introduced and what information shall be recorded on them. I say, therefore, with all due respect to what was said by the noble Lord, Lord Nugent, and others, that the Government do not consider that this is a matter on which their hands should be tied by legislation, although when they have these consultations no doubt they will bear in mind the sort of considerations he put to us in the House. My Lords, I beg to move.
