HL Deb 27 July 1967 vol 285 c1144

[Nos. 13 and 14]

Clause 2, page 4, line 6, after ("shall") insert ("for so long as the estate or interest surrendered would have endured if not so surrendered")

Clause 2, page 4, Line 7, leave out ("thereto") and insert ("to the other estate or interest")

BARONESS SUMMERSKILL

My Lords, Clause 2(4) provides that where the matrimonial home is held under a lease the charge for which Clause 2 provides cannot be lost by the surrender of the lease to the freeholder. Amendment No. 13 has the effect of making the charge on the freehold last only so long as the lessee's interest would have lasted if it had not been surrendered. Amendment No. 14 is consequential upon the previous Amendment. I beg to move.

Moved, That this House doth agree with the Commons in the said Amendments.—(Baroness Summerskill.)

On Question, Motion agreed to.
