Clause 1, page 2, line 2, after ("children") insert ("and to all the circumstances of the case")

BARONESS SUMMERSKILL

My Lords, with the leave of the House I beg to move that this House doth agree with the Commons in their Amendments Nos. 3 and 4. Amendment No. 3 is introductory to Amendment No. 4. Clause 1(3) provides that on an application for an order declaring, enforcing, restricting or terminating rights of occupation under the Bill, the court may make such order as it thinks reasonable having regard to the conduct, needs and financial resources of the spouses and the needs of any children of theirs. Amendment No. 4 makes it clear that the court may also have regard to all the circumstances of the case.

Moved, That this House doth agree with the Commons in the said Amendments, Nos. 3 and 4.—(Baroness Summerskill.)

On Question, Motion agreed to.
