After Clause 38, insert the following new clause—

Admissibility in evidence of certain matter

(". An answer given by a person to a question put to him in exercise of powers conferred by—

  1. (a) section 167 of the principal Act (as originally enacted or as applied by section 172 of that At or section (Investigation of share dealings) of this Act); or
  2. (b) general rules made under section 365(1) of the principal Act for carrying into effect the objects of that Act so far as relates to the winding up of companies;
may be used in evidence against him, and a statement required by section 235 of the principal Act (statement of company's affairs to be made to official receiver) may be used in evidence against any person making or concurring in making it.")
