HL Deb 27 July 1967 vol 285 c1153

[The references are to Bill 303 as first printed for the Commons]

Schedule 6, page 106, line 9, at end insert—

("THE CIVIC AMENITIES ACT 1967

In section 25 for the words from 'sections' to '1960', where last occurring, there shall be substituted the words 'sections 20, 52 and 53 of the Road Traffic Regulation Act 1967',")

THE LORD CHANCELLOR

My Lords, I beg to move that this House cloth agree with the Commons in their Amendment. This is a Consolidation Bill, and all this Amendment does is to add to Schedule 6, "Consequential Amendments", an Amendment of Section 25 of the Civic Amenities Act 1967. The Bill for that Act was passed only on Monday and the Amendment could not, therefore, be made before. The Amendment is needed because Section 25 refers to three sections of Road Traffic Acts which will be repealed and re-enacted in the Consolidation Act, and as both Bills may receive the Royal Assent on the same day, and I understand will do so to-day, one cannot safely rely on Section 38(1) of the Interpretation Act to effect the substitution for the reference to those three sections of a reference to the corresponding provisions of the Consolidation Act. The Amendment makes the substitution. I beg to move.

Moved, That this House doth agree with the Commons in the said Amendment.—(The Lord Chancellor.)

On Question, Motion agreed to.
