HL Deb 01 November 1966 vol 277 c493
BARONESS WOOTTON OF ABINGER

My Lords, I beg leave to ask the Question which stands in my name on the Order Paper.

[The Question was as follows:

To ask Her Majesty's Government whether it is proposed to introduce legislation to reverse the decision of the Court of Appeal that a barrister cannot be sued for negligence in the performance of his professional duty.]

THE LORD CHANCELLOR (LORD GARDINER)

My Lords, the recent decision that a barrister is not liable for negligence in connection with the conduct or management of a case in court raises important issues of policy, but the time for applying for leave to appeal to your Lordships' House has not yet expired, and therefore it would be quite wrong for me to express any opinion to-day.

BARONESS WOOTTON OF ABINGER

My Lords, I am grateful to the noble and learned Lord the Lord Chancellor for his reply.
