My Lords, Amendments Nos. 54 and 55 deal with Section 241 of the Road Traffic Act, which provides that a person shall not be convicted of certain offences unless he was either warned at the time of the offence that proceedings would be considered or was within fourteen days served with a summons of notice of an intended prosecution. The first part of the Amendment is intended to clarify the nature of the notice which the police require to give. On reconsideration, it seems unnecessary to amend the whole of paragraph (c). The present statutory requirements have been the subject of a number of High Court decisions, and if we made this change now, it might cast doubt on these decisions and cause a good deal of confusion. I think that it would be best to leave the paragraph as it is, except for the Amendments indicated. I beg to move.
