HL Deb 23 July 1962 vol 242 cc892-3

Page 16, line 34, leave out subsection (3) and insert— ("(3) In the case of any contravention of this section as regards any licensed premises, the holder of the certificate in respect of those premises shall be deemed to be guilty of a breach of that certificate and shall be liable accordingly.")

LORD CRAIGTON

My Lords, this is a drafting correction, as the only offence possible under this clause is having the shop open for selling drink outside off-sales hours, and there can be no "other case" as in subsection 3 (b). I beg to move that this House doth agree with the Commons in the said Amendment.

Moved, That this House doth agree with the Commons in the said Amendment—(Lord Craigton.)

On Question, Motion agreed to.

VISCOUNT ALEXANDER OF HILLSBOROUGH

My Lords, is it intended to go right through consideration of Commons' Amendments before we have the statement?

THE LORD PRESIDENT OF THE COUNCIL AND MINISTER FOR SCIENCE (VISCOUNT HAILSHAM)

My Lords, the only fair answer to that is that I do not know. I am waiting for my noble friend Lord Dundee, who is going to make the statement. He is not in this Chamber at the moment, and I can only assume that that is because we cannot be earlier than the other place in connection with the statement. I have not any news of the position in the other place.

LORD CRAIGTON

My Lords, I have only one more sentence to say; then everything else is formal.
