My Lords, this Amendment puts the onus of proof, in the case of legal right or permission to take or kill deer, on the prosecution, as is customary in Scottish law. The prosecution, therefore, will have to prove that the person did actually commit the offence. I beg to move that this House doth agree with the Commons in the said Amendment.
