HL Deb 22 November 1954 vol 189 c1692

Clause 6, page 6, line 34, leave out paragraph (f).

LORD CARRINGTON

My Lords, this paragraph which it is proposed to leave out would have enabled the Ministers to prohibit the sale in the open air of meat or other such products which are peculiarly susceptible to infection. We can regulate the sale of such food under the powers of Clause 6 (1) (e). We can say under that clause that it shall not 'be sold in the open air unless proper precautions are taken. We cannot, however, under Clause 6 (1) (e), prohibit it absolutely. As there is no intention of doing so, it was thought better to leave out this paragraph. It was feared that if the powers were available Ministers might use them to put a stop to the use of such things as mobile shops in country districts. I beg to move that the House doth agree with the Commons in the said Amendment.

Moved, That this House doth agree with the Commons in the said Amendment.—(Lord Carrington.)

EARL JOWITT

My Lords, I do not follow the reference to Clause 6 (1) (e).

LORD CARRINGTON

I beg your Lordships' pardon if I have not explained it right. Under Clause 6 (1) (e)—

EARL JOWITT

There is no (e).

LORD CARRINGTON

No, of course not: it should be Clause 6 (1).

On Question, Motion agreed to.
