§ [The references are to Bill 71 as first printed for the House of Commons]
§ Clause 1, page 1, line 9, leave out ("also") and insert ("nevertheless").
328§ THE LORD CHANCELLORMy Lords, this is the most technical and complicated small Bill I think I have ever had the privilege of dealing with, but I do not think I need trouble your Lordships at any great length with these Amendments. The intention of the first Amendment is simply to ensure that, where the objects of a trust are both charitable and non-charitable, the trust is to be regarded as a valid one although the funds can be applied for non-charitable as well as charitable purposes. It was suggested in another place that the word "also" created some ambiguity. I do not think it did, but if it is considered that we should make it more clear by putting in the word "nevertheless," I am content that it should be so. I think the result is precisely the same. I beg to move that the House do agree with the Commons in the said Amendment.
§ Moved, That this House do agree with the Commons in the said Amendment.—(The Lord Chancellor.)
§ On Question, Motion agreed to.
