Clause 78, page 38, line 37, at end, insert— ("(3) Nothing in this Act shall make it unlawful to detain an accused person in custody pending trial otherwise than in prison if such detention would lave been lawful prior to the commencement of this Act.")

My Lords, if I may explain it in a few words, this is purely a drafting Amendment. If the Amendment were not made the law would be changed, which is not the intention of a Consolidation Act. Accordingly, I beg to move that this House do agree with the Commons in the said Amendment.
