Order of the Day read for the consideration of the Report from the Committee for Privileges that Henry James Scrymgeour-Wedderburn had made out his claim to the titles, honours and dignities of Viscount Dudhope and Lord Scrymgeour in the Peerage of Scotland.

The Committee reported as follows:

That—

  1. (1) the dignities of Viscount Dudhope and Lord Scrymgeour were created by Patent under the Great Seal of Scotland dated 15th November, 1641, in favour of Sir John Scrymgeour of Dudhope, Constable of Dundee, and holder of the Hereditary Office of King's Standard Bearer for Scotland, and the heirs male of his body whom failing his heirs male whatsomever:
  2. (2) the said dignities descended under the first limitation of the Patent to the grandson of the Patentee John 3rd Viscount Dudhope and Lord Scrymgeour, also Earl of Dundee, and that on the death of the said John the heirs male of the body of the Patentee became extinct;
  3. (3) the Claimant Henry James Scrymgeour-Wedderburn, of Wedderburn and Birkhill, is descended in the male line from Sir James 494 Scrymgeour, Constable of Dundee and King's Standard Bearer, who was killed at Harlaw in 1411 an ancestor in the male line of the above-mentioned John 3rd Viscount Dudhope;
  4. (4) all the collateral heirs male of the said dignities of Dudhope and Scrymgeour in terms of the said limitations intervening between the 3rd Viscount Dudhope and the Claimant are now deceased and have no male issue surviving;
  5. (5) accordingly the Claimant Henry James Scrymgeour-Wedderburn, of Wedderburn and Birkhill, is the heir male of the said Patentee Sir John Scrymgeour under the terms of the second limitation of his patent and is now entitled of right to the dignities of Viscount Dudhope and Lord Scrymgeour.
