HL Deb 14 December 1948 vol 159 cc1040-1

5.28 p.m.

Order of the Day for the House to be put into Committee read.

Moved, That the House do now resolve itself into Committee.—(Lord Chorley.)

On Question, Motion agreed to.

House in Committee accordingly:

[The LORD HOLDEN in the Chair]

Clauses 1 to 8 agreed to.

First and Second Schedules agreed to.

Third Schedule [Enactments repealed]:

LORD CHORLEY

This Amendment is purely drafting. As your Lordships see, the Third Schedule is a repealing Schedule. As the Road Haulage Central Wages Board is being abolished, it is necessary to repeal those parts of other enactments which refer to it. One which has been overlooked is the reference in the Road Haulage Wages (Emergency Provisions) Act, 1940. This Amendment has been tabled in order that this particular reference in that Act may be abolished. I beg to move.

Amendment moved— Page 9, line 43, column 3, at end insert ("the words 'with the Central Board and'").—(Lord Chorley.)

LORD LLEWELLIN

As the noble Lord has said, this Amendment appears to us to be drafting. It brings the Schedule into line with what has been decided, and we take no objection to it.

On Question, Amendment agreed to.

LORD CHORLEY

My Lords, with your permission I will take the two following Amendments together. They have been tabled because the Schedule as at present drafted goes rather too far. We can, of course, only repeal in so far as the substantive provisions of the Bill itself require it. The C licence is left intact by the Bill, but the Road Haulage Wages (Emergency Provisions) Act of 1940 covers the C as well as the A and B licences. If the Schedule were to stand as it is tabled at present, the provisions would relate to C licences but not in the same manner as to A and B licences. These two Amendments have been tabled in order to preserve the C licence, and I think your Lordships will agree that they are effective to secure that purpose. I beg to move.

Amendment moved— Page 9, line 48, column 3, leave out ("from").—(Lord Chorley.)

On Question, Amendment agreed to.

LORD CHORLEY

I beg to move.

Amendment moved— Page 9, line 49, column 3, leave out ("to the end of the subsection") and insert ("of the Central Board").—(Lord Chorley.)

On Question, Amendment agreed to.

Third Schedule, as amended, agreed to.

Then, Standing Order No. XXXIX having been suspended (pursuant to Resolution of December 9), Bill reported with Amendments; Bill read 3a with the Amendments, and passed, and returned to the Commons.
