HL Deb 31 July 1947 vol 151 cc847-8

[The references are to Bill (46).]

Clause 9, page 6, line 38, after the second ("to") insert ("a").

THE LORD CHANCELLOR (VISCOUNT JOWITT)

My Lords, the purpose of this Government Amendment is to meet the criticism that, without it, the clause might have prevented an action brought by a person injured as a result of negligence in the carrying out of repairs or maintenance work on telephone lines, and that the phrase "telephonic communication" might mean the system of communication as distinct from the telephone message. This Amendment makes it clear that claims for negligence are excluded only in regard to matters relating to a particular telephonic communication. I beg to move, in this case, as I propose to move in the cases of the Amendments which follow, that this House doth agree with the Commons.

Moved, That this House doth agree with the Commons in the said Amendment.—(The Lord Chancellor.)

On Question, Motion agreed to.
