Clause 5, page 9, line 19, leave out from ("Commission") to end of clause and insert ("the scheme shall include, or, where there is no such scheme, the Minister shall by Order make such transitional provisions as to the parties by and against whom, legal proceedings are to be instituted or continued, and such other transitional provisions, if any, as appear to the Commission and the Minister to be expedient").

The Commons disagreed to this Amendment, but proposed the following Amendment, in lieu thereof, to the words so restored to the Bill: Page 9, leave out lines 20 to 24, and insert ("shall include such transitional provisions as to the parties by and against whom legal proceedings are to be instituted or continued, and such other transitional provisions, if any, as appear to the Minister, or to the Commission and the Minister, as the case may be, to be expedient.")

My Lords, I beg to move that this House do not insist on our Amendment and agree to the Commons Amendment in lieu thereof. This is another example of an Amendment made to the Bill as a result of representations from noble Lords opposite. This was a case in which the noble Viscount, Lord Simon, asked us to secure provision for legal proceedings where an Executive was set up, and I am informed that it has been considered carefully with a view to improving it. The proposed new words effect in a clearer and better way your Lordships' wishes than the Amendment in its original form. I beg to move.
