HL Deb 30 September 1941 vol 120 c76

LORD MOYNE has given Notice that he would move to resolve, That this House, having heard the statement of the Lord Chancellor as to the devolution of the Stamp Peerage, approves the conclusion at which he has arrived that the Writ in respect of this Peerage should issue to Trevor as third Lord Stamp in succession to his elder brother Wilfrid, second Lord Stamp, deceased.

The noble Lord said: My Lords, you will remember that before the adjournment we were advised by the Lord Chancellor that we were justified in applying the analogy of the Law of Property Act and assuming that the late Lord Stamp predeceased his eldest son. As there was very general agreement, not only from the legal authorities of the House but also from several noble Lords who took part in the short discussion, I have put on the Order Paper, in accordance with what was the wish of the House, a Motion that the Writ shall issue to the present Lord Stamp as the third Peer. I beg to move.

Moved to resolve, That this House, having heard the statement of the Lord Chancellor as to the devolution of the Stamp Peerage, approves the conclusion at which he has arrived that the Writ in respect of this Peerage should issue to Trevor as third Lord Stamp in succession to his elder brother Wilfrid, second Lord Stamp, deceased.—(Lord Moyne.)

On Question, Motion agreed to.
