Clause 18, page 15, line 36, leave out subsection (3) and insert: ("(3) Rules made under paragraph (a) or paragraph (b) of subsection (1) of this section shall not apply to—

  1. (a) a solicitor acting in the course of his employment as a public officer as defined by Section four of the Solicitors Act, 1933; or
  2. (b) a solicitor acting in the course of his employment in an office to which Section five of that Act applies; or
  3. (c) a solicitor in whole-time employment as an officer of a local authority as defined by Section six of that Act acting as such officer.")

My Lords, this Amendment provides for certain exceptions to the principal obligation under Clause 18. That obligation requires solicitors who are trustees to keep certain accounts, and this Amendment provides that that shall not apply to solicitors who act in certain public employment or in certain employments of a public nature, such as officers of a local authority, clerks of the peace, clerks to the justices, and so on. It will bring the provision in Clause 18 into line with the provisions made in the principal Solicitors Act of 1893, which provides for rules being made as to the keeping of accounts. I beg to move that the Amendment be agreed to.
