Clause 2:

Amendments as to certain items in Legislative Lists.

(2) After paragraph 48 of the Provincial Legislative List, there shall be inserted the following paragraphs: 48A. Taxes on vehicles suitable for use on roads, whether mechanically propelled or not.

THE SECRETARY OF STATE FOR INDIA (THE MARQUESS OF ZETLAND) moved, in subsection (2), at the end of paragraph 48A, to insert "including tram-cars." The noble Marquess said: The purpose of this small Amendment which stands in my name is to include tram-cars as a subject of taxation by the Provincial Governments in the appropriate Schedule of the original Act. By an oversight this item was omitted when the Bill was drafted. As a result of representations, to which I have been able to give further consideration, from the Government of Bengal, I have now put down this Amendment. It appears that tram-cars are already a subject of taxation in one at least of the Provinces of India, and it is therefore desirable that no doubts as to the power of Provincial Governments to levy these taxes should be allowed to remain. I beg to move.
