HL Deb 01 February 1938 vol 107 c570

Consequential and minor amendments of Patents and Designs Act.

Section amended. Amendment.

Forty-eight

For subsection (2) there shall be substituted the following subsection: (2) In this section, the expression 'Convention vessel' means a vessel of a Convention country; the expressions 'Convention aircraft' and 'Convention land vehicle' have corresponding meanings; and the expression 'Convention country has the meaning assigned to it by, or by virtue of, Section ninety-one A of this Act.

LORD TEMPLEMORE

The first two Amendments to the Schedule are drafting. The interpretation of the expression "Convention country" wherever it appears in the Patents and Designs Act, as amended by the Bill, is already provided for by Clause 9 of the Bill, so that the interpretation of that expression for the special purpose of Section 48 is redundant.

Amendment moved— Page 11, line 21, after ("country") insert ("and").—(Lord Templemore.)

On Question, Amendment agreed to.

Amendment moved— Page 11, line 24, leave out from ("meanings") to end of line 27.—(Lord Templemore.)

On Question, Amendment agreed to.

LORD TEMPLEMORE

The next two Amendments are consequential on the new clause which I moved a few moments ago, regarding appeals from certain decisions of the Comptroller, proposed to be inserted in the Bill after Clause 6.

Amendments moved—

Page 12, line 14, after ("Comptroller") insert ("or on appeal the Appeal Tribunal")

Page 12, line 25, at end insert ("or (on appeal) the Appeal Tribunal may direct such acceptance and grant as aforesaid").—(Lord Templemore.)

On Question, Amendments agreed to.
