Read 3a, with the Amendments (according to Order).

Clause 2:

Exemption as respects Jewish retail dealers in meat.

2. Notwithstanding anything in this or any other Act, any person of the Jewish religion may carry on the business of a retail dealer in kosher meat and may keep open a shop for the serving of customers for the purposes of that business on Sunday, on condition that he complies with the following provisions (that is to say):— (a) he must be licensed by the local Board of Shechita, or in the absence of any such Board by the local Jewish congregation, for the sale of kosher meat;

LORD ELTISLEY moved, after "Act," to insert "prohibiting the carrying on of business on Sunday." The noble Lord said: My Lords, all the Amendments in my name on the Order Paper are of a drafting character. I think they are acceptable in every way, as they are to me as mover of the Bill. There is only one other Amendment, that by the noble Viscount, Lord Bertie of Thame. This Amendment will no doubt be explained in due course, but as far as the promoters of the Bill are concerned, it is quite acceptable. I beg to move.

LORD ELTISLEY moved, in paragraph (a), to leave out "the local Jewish congregation, for the sale of kosher meat" and insert "a committee appointed for the purpose by the local Jewish congregation established in accordance with Jewish law." The noble Lord said: My Lords, I beg to move this Amendment. As I have explained, it is drafting.

Clause 4:

Provisions as to delivery of goods.

4. It shall not be lawful to dispatch any butchers' meat or kosher meat from a shop or to deliver any butchers' meat or kosher meat so dispatched at any time when under the provisions of this Act the shop may not be open for the serving of customers.

LORD ELTISLEY moved to leave out "or kosher meat" in both cases where those words occur. The noble Lord said: My Lords, these words were accepted during the Report stage and since the Bill was last printed.

VISCOUNT BERTIE OF THAME moved to insert at the end of the clause: Provided that the provisions of this section shall not apply:

  1. (a) on any Sunday being also Christmas Day; or
  2. (b) on any Sunday when the succeeding Monday is Christmas Day. "

The noble Viscount said: My Lords, this proviso appears in the Shops (Sunday Trading Restriction) Bill which will be before your Lordships later. I think it is a useful proviso, and for the benefit of the public in general. I do not think this Bill should differ from the Bill to which I have referred. I therefore beg to move the Amendment.
