HL Deb 01 August 1935 vol 98 c1061

Clause 11, page 14, line 13, at end insert the following new clause:—

Effect of restrictions where land is acquired compulsorily.

(". Where land subject to restrictions in force under Section one or Section two of this Act is acquired by a highway authority by means of an order made under this or any other Act authorising compulsory purchase of the land, any compensation payable in respect of any estate or interest in the land shall be assessed as if the restrictions were not in force if compensation in respect of injury to that estate or interest occasioned by the restrictions has been paid under this Act neither to the person having that estate or interest nor to any of his predecessors in title.")

THE EARL OF PLYMOUTH

My Lords, this new clause is substantially the same as proviso (a) to Clause 10 (1) in the Bill as printed. It seemed equitable to extend the safeguards of that proviso to compulsory purchase by the highway authority under whatever Act. I beg to move that this House doth agree with the Commons Amendment.

Moved, That this House doth agree with the Commons in the said Amendment.—(The Earl of Plymouth.)

On Question, Motion agreed to.
