Page 11, line 1, at the beginning insert the following new clause:

Power of public Departments to make agreements as to restrictions.

(".—(1) For the purpose of co-operating with any highway authority in giving effect to the purposes of Section one or Section two of this Act, any public Department may, subject to the approval of the Treasury, enter into agreements for securing that any land which is under their control, or which is in their occupation or vested in them for public purposes or for the public service, shall, so far as may be provided by any such agreement, be subject to the like restrictions as are specified in the said sections; and any agreement so made may contain such consequential and incidental provisions including provisions of a financial character as appear to be necessary or desirable:

Provided that the Department concerned in making an agreement under this section, and the Treasury in considering whether their approval shall or shall not be given to the agreement, shall have regard to the purposes for which the land in question was acquired or is held by the Department.

(2) Where any agreement made under the last foregoing subsection provides for the making of payments by a highway authority to a public Department, any sum paid in pursuance of such a provision shall, except in so far as may be otherwise provided by the agreement, be deemed for the purposes of this Act to be paid as compensation under this Act.")

My Lords, this clause merely applies to the present Bill the precedent of Section 33 of the Town and Country Planning Act, 1932, the wording of which it follows very closely.
