THE MARQUESS OF LONDONDERRY

My Lords, the object of this Amendment is to meet the criticism which has been expressed that in its original form the clause would empower the licensing authority to refuse a licence if the applicant has been convicted of some trivial offence in connection with the management of a track or even of some offence in connection with the management of the track committed before the passing of the Act. The Amendment proposes that before it can be a bar to the grant of a licence a conviction should be in respect of an offence against Part I or the First Schedule of this Bill (which deals with the conduct of tracks) or an offence against the general law relating to fraud or dishonesty.
