The Question was as follows:—

[To ask His Majesty's Government what are the regulations which bind the Railway and Canal Commissioners in their inquiries under the Mines (Working Facilities and Support) Act, 1923, by whose authority are they made, and how can they be revoked or altered.]

My Lords, the answer to the noble Lord's Question is that by Section 10 of the Mines (Working Facilities and Support) Act, 1923, the provisions of the Railway and Canal Traffic Act, 1888, as amended, relating to the determination of questions under that Act, are applied to the determination of questions under the former Act. The rules relating to the procedure of the Railway and Canal Commission are made by the Railway and Canal Commissioners, with the approval of the Lord Chancellor and the Secretary of State for the Home Department. The authority under which these rules are made is Section 20 of the Railway and Canal Traffic Act, 1885. The rules may be revoked or varied by the same rule-making authority.
