HL Deb 28 March 1933 vol 87 cc136-8

Provisions as to Determination of Compensation Payable to Officers and Servants.

7. In the case of an officer or servant, of any other undertaking transferred in whole or in part to the Board by this Act (other than the Metropolitan undertaking), the Board or the arbitrator in computing the length of his service for the purposes of the award of compensation shall take into account all his service after the age of eighteen years, being continuous service whether with the undertaking or part of the undertaking, as the case may be, in whose service he was immediately before the appointed day or with any other passenger transport undertaking which has been acquired by, or absorbed in, that undertaking.

THE MARQUESS OF LONDONDERRYmoved, in paragraph 7, after "Metro- politan undertaking," to insert "and in the case of any person who is deemed to be an existing officer or servant by virtue of Section seventy-four of this Act." The noble Marquess said: My Lords, it will be recollected that during the Committee stage Lord Ponsonby moved two Amendments to a Government Amendment to the Schedule which now appears as paragraph 7 of that Schedule. The Amendment now proposed by the Government is designed to give effect to what is understood to be the purpose of the first Amendment moved by Lord Ponsonby during the Committee stage. The effect of the Amendment will be that persons employed by an undertaking or part of an undertaking taken over by the Board under Clauses 16 or 17 will, if they become entitled to claim compensation from the Board under the conditions laid down in Clauses 73 and 79, be able to claim that, in assessing the amount of compensation, continuous service, after the age of 18 years, with the undertaking taken over and with any passenger transport undertaking absorbed in or acquired by it, shall be taken into account. I beg to move.
