HL Deb 09 May 1929 vol 74 cc509-10

Order of the Day for the House to be put into Committee read.

Moved, That the House do now resolve itself into Committee.—(The Earl of Stradbroke.)

House in Committee accordingly:

[The EARL OF DONOUGHMORE in the Chair.]

Clause 1 agreed to.

Clause 2:

Transfer to Central Board of functions of county councils with respect to land drainage.

2.—(1) All powers, duties and obligations with respect to the drainage of land which, by virtue of the Land Drainage Act, 1926, are vested in or required to be performed by the council of any county or county borough any part of the area of which is comprised in the Doncaster district, but excluding any power to levy any rate other than a drainage rate and any power to borrow money, shall, by virtue of this Act, so far as they relate to land within the Doncaster district, be transferred to and become powers, duties and obligations of the Central Board:

Provided that, any expense which the Central Board may incur, by reason of the exercise by the Board of any powers conferred by such subsection 1 (1) (a) of the Land Drainage Act, 1926, with respect to any drainage work under the control and jurisdiction of any district drainage board, may at the option of the Central Board be recovered direct from the district board as a civil debt.

THE EARL OF STRADBROKE moved, in the proviso in subsection (1), to leave out "such subsection 1 (1) (a)" and insert "subsection (1) (a) of Section one". The noble Earl said: I ought to point out to your Lordships that on the Paper issued this morning there is a printer's error. After subsection in the words I propose to insert there is the figure 1 not in brackets which ought to come out. It will then read "subsection (1) (a) of Section one." I beg to move.

Amendment moved— Page 3, line 7, leave out ("such subsection 1 (1) (a)") and insert ("subsection (1) (a) of Section one").—(The Earl of Stradbroke.)

Clause 2, as amended, agreed to.

THE LORD CHAIRMAN

I suggest we might take all the remaining clauses unless any of your Lordships desire to take any point upon them.

Remaining clauses agreed to.

Schedule agreed to.

Then, Standing Order No. XXXIX having been suspended, Amendment reported: Bill read 3a, and passed, and returned to the Commons.
