HL Deb 01 August 1928 vol 71 c1542

Schedule, page 8, line 7, at end insert:

("5. Nothing in this Order affects prejudicially any estate right power privilege or exemption or the Crown.")

Schedule, page 24, line 18, at end insert:

("Provided further that the Corporation shall not exercise such powers in respect of any streets roads land or other property of a railway company without the previous consent of such railway company but such consent shall not be unreasonably withheld. Any question whether or not such consent has been unreasonably withheld shall be determined by the Minister of Health.")

VISCOUNT GAGE

My Lords, the first of these two Amendments affecting Bradford was put in at the request of the Treasury for the purpose of ensuring than the provisions of the Order should not affect the Crown's rights in respect of Entertainment Tax. The second Amendment was introduced into the Darlington Order and enables railway companies to object to the Corporation exercising in respect of railway property the power given to the Corporation by Article 14 of the Order to carry water mains through private streets and private property generally. I beg to move that this House doth agree with the Commons in the said Amendments.

Moved, That this House doth agree with the Commons in the said Amendments.—(Viscount Gage.)

On Question, Motion agreed to.
