Read 3a (according to Order).

Clause 9:

Right of illegitimate child and mother of illegitimate child to succeed on intestacy of the other.

(4) This section shall apply to Scotland with the substitution of "heritable" for "real" and "moveable" for "personal."

THE LORD CHANCELLOR moved to leave out subsection (4) and insert the following subsection: Subsections (1) and (2) of this section shall apply to Scotland with the substitution of 'heritable' for 'real' and 'moveable' for 'personal,' and the expression 'intestate' therein occurring shall have the same meaning as in the Intestate Moveable Succession (Scotland) Act, 1855, provided always that nothing in this section shall affect the right of any person to succeed under any entail. The noble and learned Viscount said: My Lords, this is a drafting Amendment which comes from the Scottish Office at the last moment and is intended to apply this particular clause to the Scottish law.

Amendment moved— Clause 9, page 5, lines 16 to 18, leave out subsection (4) and insert the said new subsection.—(The Lord Chancellor.)
