Provisions relating to applications for augmentation of stipend.

1. Where an application is made by a Minister or by the General Trustees the Court of Teinds shall, in so far as there is sufficient free teind, give effect to any agreement as to the amount of the augmentation to be granted made between the heritors concerned on the one part and the minister with consent of the General Trustees or the General Trustees as the case may be on the other part.

2. In considering what effect (if any) ought to be given to—

  1. (a) the circumstance that the application is final; and
  2. (b) (in cases where the application is made before the expiry of twenty years from the last application for augmentation) the circumstance that the application is so made
the Court of Teinds shall not be bound to proceed on the basis of the average fiars prices for the seven years preceding the application.

3. Any application shall, subject to the provisions of this Act, be made and be dealt with in such manner as the Court of Session by Act of Sederunt may prescribe.
