Clause 12:

Application to Scotland.

12. This Act shall apply to Scotland, with the following modifications:— (c) The expression "court of summary jurisdiction" means the sheriff. (d) Subsection (1) of section three of this Act shall have effect as if there were inserted after the term "certified," wherever the same occurs therein, the term "Grade A. (tuberculin tested).

THE PARLIAMENTARY SECRETARY OF THE MINISTRY OF HEALTH (THE EARL OF ONSLOW) moved, at the end of paragraph (c), to insert "subsection (3) of section two of this Act shall not apply provided that any decision by a sheriff-substitute under subsection (2) of the said section may be appealed to the sheriff." The noble Earl said: My Lords, I have three Amendments which are practically drafting. The first of these applies to Scotland the same right of appeal as exists in England, while the second concerns the expenses of the clause. Conditions in Scotland are different from those which obtain in this country, and this clause is to put Scotland on all fours with England in that respect. There are other minor Amendments which were not on the Paper in time, and it is proposed to move them in another place.

Page 6, line 21, at end insert the following new paragraph: ("(e) The following subsection shall be substituted for section ten of this Act: The provisions of this Act shall be enforced by the local authorities under the Public Health (Scotland) Act, 1897, and any expense thereby incurred shall be defrayed out of the public health general assessment"). Clause 12, page 7, line 9, at end insert the following new paragraphs: (f) In subsection (2) of Clause 9 of this Act references to the procurator fiscal shall be substituted for references to the local authority. (g)Clause 11 of this Act shall not apply."—(The Earl of Onslow.)
