HL Deb 18 August 1919 vol 36 c1016

Clause 2, page 1, line 12, after ("shall") insert ("wherever possible").

Clause 2, page 1, line 14, leave out from ("forces") to the end of the clause and insert ("so as to secure that the distribution by the Admiralty, the Secretary of State, or the Air Council, of property or funds of such deceased, whether partly before the passing of this Act or not, shall be in conformity with the law of intestate succession in Scotland as amended by this Act").

THE LORD CHANCELLOR (LORD BIRKENHEAD)

My Lords, these Amendments are drafting. In many cases the Admiralty, the War Office, or the Air Council have partially distributed the funds due to deceased members, and in some of those cases that partial distribution makes it impossible to dispose of the balance so as to make the distribution of the whole conform to the law as now amended. The intention of these Amendments is to except the last-mentioned cases from the operation of the part of Clause 2 to which I called attention on Second Reading, and also to make more clear in the Bill than it was as originally what the Admiralty, the War Office, and the Air Council are to do in regard to the funds in their hands.

Moved, That this House doth agree with the Commons in the said Amendments.—(The Lord Chancellor.)

On Question, Motion agreed to.
