Order of the Day for the House to be put into Committee, read.

Moved, That the House do now resolve itself into Conunittee.—(The Lord Chancellor.)

On Question, Motion agreed to.

House in Committee accordingly.

[The EARL OF DONOUGHMORE in the Chair.]

Clauses 1 to 4 agreed to.

Clause 5:

5. It shall not be lawful for the said Thomas Robert Nash Miles to intermarry with any woman on account of whose adultery with him his marriage with the said Margaret Emma Miles is dissolved by this Act.

THE LORD CHANCELLOR (LORD FINLAY)

My Lords, this is a clause introduced under the Standing Orders, but it has been usual for a long time to strike it out in Committee. I beg to move that Clause 5 be deleted.

Amendment moved— Leave out, Clause 5.—(The Lord Chancellor.)

On Question, Amendment agreed to.

Clause 6:

6. The said Thomas Robert Nash Miles shall pay the costs of the said Margaret Emma Miles of promoting this Bill when taxed and ascertained.

THE LORD CHANCELLOR

My Lords, this is a clause providing that the husband shall pay the costs of the wife. It was stated by the counsel who appeared for the wife at the Bar of the House on the Second Reading that she did not desire to take the benefit of this clause, and preferred that it should be struck out. I beg to move that it be omitted.

Amendment moved— Leave out Clause 6.—(The Lord Chancellor.)

On Question, Amendment agreed to.
