Clause 6:

Variation of settlements.

6. The said two Indentures of settlement dated the eighteenth day of July One thousand nine hundred and five shall respectively be varied in the following manner (videlicet.):—

  1. (1) The grant by the Indenture first hereinbefore recited of a yearly rentcharge of two hundred pounds shall become and henceforth be null and void and the lands upon which the said rentcharge was charged shall henceforth be freed released and discharged there from and the grant demise and disposition of the said lands to the said Robert Lecky and Alfred Edward Brett made by the same Indenture shall also henceforth become and be null and void and the said lands shall be held and enjoyed to all intents and purposes as if such grant demise and disposition had not been made;
  2. (2) The assignment by the same Indenture to the said Robert Lecky and Alfred Edward Brett of the two Policies of Assurance on the life of the said Hugh Lecky shall become and henceforth be null and void and the said Policies and the proceeds thereof shall be held and enjoyed by the said Hugh Lecky to all intents and purposes as if such assignment had not been made;
  3. (3) The interests of the said Annie Margaret Lecky and all persons claiming or to claim through from or under her under the same Indenture in the said rentcharge and the said Policies of Assurance and the proceeds thereof shall cease and determine;
  4. (4) The said Robert Lecky and Alfred Edward Brett or other the Trustees or Trustee for the time being of the Indenture secondly hereinbefore 342 recited shall hold the two sums of One thousand pounds each now vested in them pursuant to the provisions of that Indenture In trust for the said Annie Margaret Lecky absolutely and the interest of the said Hugh Lecky and all persons claiming or to claim through from or under him under the said Indenture in the said two sums and the income thereof shall cease and determine.

My Lords, this Amendment to Clause 6 and the subsequent Amendments are considered necessary in connection with this Bill, and with your Lordships' permission I move that all the Amendments standing on the Paper be inserted.

Amendment moved— Clause 6, page 7, subsection (1), line 21, leave out from ("the") [" shall hold the"] to ("In") in line 23 and insert ("securities representing the proceeds of the Policy of Assurance therein referred to and the further sum of One thousand pounds also therein referred to and the income of such securities").—(The Lord Chancellor.)

Proviso that Annie Margaret Lecky is not to marry Robert Fox Goodman.

7. Provided always and be it further enacted that it shall not be lawful for the said Annie Margaret Lecky at any time hereafter to contract matrimony with the said Robert Pox Goodman but that such matrimony shall be and is hereby declared to be illegal and void to all intents and purposes whatsoever and the child and children born therein shall be illegitimate and subject to all the disabilities privations and restrictions to which any child or children born out of lawful wedlock is or may be subject by the laws and customs of the United Kingdom or any part thereof.
