Clause 6:

Variation of trusts of post-nuptial settlement dated 8th June, 1909.

6. The annuity of four hundred pounds payable to the said Nellie Viola Castalia Florence Gore during the joint lives of your subject and the said Nellie Viola Castalia Florence Gore and all other whatsoever interest and benefit given to the said Nellie Viola Castalia Florence Gore expectant upon the death of the said Reginald Edward Gore or otherwise in the property subject to the said Indenture of settlement of the eighth day of June One thousand nine hundred and nine shall cease and determine and the trustee or trustees for the time being of the said settlement shall henceforth stand seised and possessed of the property subject thereto upon the same trusts as would have been applicable in respect thereof in case the said Nellie Viola Castalia Florence Gore were dead and had died in the lifetime of the said Reginald Edward Gore and all powers of appointment amongst the children or remoter issue or of new trustees of the said settlement of the eighth day of June One thousand nine hundred and nine reserved to the said Nellie Viola Castalia Florence Gore shall henceforth cease and determine.

My Lords, I move the Amendments which stand in my name. They are only two. The first—in Clause 6—is to give effect to the alterations in the settlement consequent upon the divorce; and the second is the usual Amendment to strike out that clause in the Bill—Clause 7—which forbids the intermarriage of the guilty parties.

Amendments moved— Clause 6, line 8, after the third ("and"), insert ("the said Reginald Edward Gore shall be entitled to the whole of the income of the settled fund during the remainder of his life as if the said Nellie Viola Castalia Florence Gore were now dead and the said Henry Ernest Garle and Edward Bertram Parker or other") line 10, after the word ("upon"), insert ("the trust in favour of the said Reginald Edward Gore by this section created and subject thereto upon") line 11, after the word ("thereof") and in substitution of rest of clause (which delete) insert ("if the clauses in the said settlement under which the said annuity and other interest and benefit arise had not been included therein and if any power of appointment or consent thereby conferred upon the said Nellie Viola Castalia Florence Gore had not been so conferred and any power of appointment or consent thereby conferred upon the said Nellie Viola Castalia Florence Gore jointly with the said Reginald Edward Gore had been conferred solely upon the said Reginald Edward Gore but save as expressly provided by this clause the said settlement shall remain in full force and effect").—(Lord Wrenbury.)

Proviso that Nellie Viola Castalia Florence Gore not to marry Walter Arnold Conduit.

7. Provided always and be it further enacted that it shall not be lawful for the said Nellie Viola Castalia Florence Gore at any time hereafter to contract matrimony with the said Walter Arnold Conduit but that such matrimony shall be and is hereby declared to be illegal and void to all intents and purposes whatsoever and the child and children born therein shall be illegitimate and subject to all the disabilities privations and restrictions to which any child or children born out of lawful wedlock is or may be subject by the laws and customs of the United Kingdom or any part thereof.
