Question again proposed, That the clause stand part of the Bill.

Mr. Marlow

We should not want my right hon. Friend to resign, but the reason that he gave for having to was that the Government gave a commitment. But the Government gave a commitment about the Bill before Bruges, at a time when the Community was running out of funds. Now that the Community has money there is no need to pass the Bill, because it is not short of funds. I assure my right hon. Friend that we shall not require his resignation if the Government lose the clause this evening. So perhaps he will change his mind, and then we may get financial discipline in the Community.

On a point of order, Miss Boothroyd. I think that the next matter that the Committee will decide is whether to divide on new clause 3. If not, it will be new clause 4.

On a point of order, Miss Boothroyd. Had I or my hon. Friends wished to divide on new clause 3, which had been selected, there would now be another Division, taking approximately 15 minutes. You will know, Miss Boothroyd, because you were in the Chair at the time, that the business motion was passed at 10 o'clock. You will also notice on the Order Paper that the business after the Committee has decided to finish is a prayer. No penalty time is available, so that debate must finish at 11.30 pm, come what may. Therefore, any time taken now in any Division, such as a Division on new clause 3, and any debate or Division on new clause 4 will automatically reduce the time available to Her Majesty's Opposition in debating the prayer.

I am willing to believe that that is an unusual circumstance that has come about through inadvertence, but I hope that you, Miss Boothroyd, will confirm that what I have said is correct and that others who are listening may take note of this so that it does not happen again because it may be said to restrict unduly the freedom of speech, which the Government are beginning to do in several different ways.
