§ Mr. CLYNESMay I ask the Prime Minister if he will announce the business for next week?
§ The PRIME MINISTEROn Monday, Tuesday, Wednesday, Thursday and Friday, the Trade Disputes and Trade Unions Bill, Committee, fourth to eighth allotted days, inclusive, and, if time permit, other Orders on the Paper; of course bearing in mind what I said earlier in the afternoon, that if the promised statement by the Home Secretary is made on Tuesday, then we are prepared to give Thursday in the event of the Opposition desiring to put down a Vote of Censure, or to put down any Vote on Thursday to enable mere discussion, if that be desired. It is difficult at this moment to say what time will be required next week after the statement is made.
§ Mr. CLYNESMay I take it that that statement means that the Opposition have a choice of methods with regard to Thursday in the event of their finding it necessary to put down a Motion on the question of the Arcos raid after the Home Secretary's statement on Tuesday next?
§ The PRIME MINISTERIf the Motion is in the form of a Vote of Censure, of course.
§ Mr. CLYNESI understood the Prime Minister to say, "or other Resolution."
§ The PRIME MINISTERindicated dissent.
§ Mr. CLYNESDoes the Prime Minister deny to the Opposition the right to frame this Motion in their own terms?
§ The PRIME MINISTERThe universal practice of the Government, when time is desired, is to give that time on the Vote of the necessary Department, and it is always the choice of the Opposition to call for a day if they desire to put down a Vote of Censure. When the business of the House can easily afford the time, it has been the custom—I have done it myself—to give a separate day entirely; but at this time of the Session it is impossible to spare the day unless it be for the purpose of putting down a Vote of Censure.
§ Mr. A. HENDERSONThe last reply of the Prime Minister compels me to bring to the notice of the House what has actually taken place on this question of the Government providing time to discuss this Arcos business. On Monday last I was rung up by the Home Secretary, and he appealed to me not to move the Adjournment of the House on that day for reasons which I considered sufficiently important to justify my giving him an undertaking that I would not do so. I then put a question to him as to whether he would arrange with the Prime Minister that we should have time for a Debate immediately following his full statement. Just when I was going to the executive meeting of my party at 1.45 he rang me up again to intimate that he had consulted with the Prime Minister, who had undertaken that we should have time afforded us by the Government for the discussion. There was nothing said as to our taking the Home Office Vote. If it had been mentioned, I should have declined to take it for the reason that the issue raised could not be properly discussed on the Home Office Vote. The Prime Minister this afternoon asked us to defer the question until Thursday to enable the Foreign Minister to be present. I repeat that it cannot properly be discussed on the Home Office Vote. Nor was there anything said to tie the Opposition down to moving a Vote of Censure. Surely if we were promised time, as we were, it should be left to the Opposition to decide what form the Motion should take. [HON. MEMBERS: "Speech!"] Unless we can have an undertaking that the time will be pro- 1374 vided, and that we shall be allowed to put down our own Motion, I must ask you, Mr. Speaker, in view of all that has taken place, to allow me to move the Adjournment of the House in order to call attention to this matter.
§ Sir W. JOYNSON-HICKSPerhaps I may be allowed to say one word, and I think the right hon. Gentleman will accept what I am going to say. While I accept his statement about the telephone communications, I think I did add that the method must be arranged by an interview between himself and the Chief Whip.
§ Mr. HENDERSONI do not think that statement alters the position. I have been long enough in this House to know that arrangements through the usual channels do not permit of the other side dictating in what form a Motion should be moved. I want to appeal to the Prime Minister on this point. He has given us Thursday. Now the question is whether the Opposition is to be entitled to put down its own Motion.
§ The PRIME MINISTEROn Thursday, on the relevant Vote, the matter can be discussed in all its aspects, and a Motion for the reduction of the Minister's salary can be put down. This does not prejudice any future discussion because, as the House knows, every Vote can be kept open until the House has decided.
§ Mr. HENDERSONIn view of the unsatisfactory reply, I beg to ask leave to move the Adjournment of the House for the purpose of discussing a definite matter of urgent public importance, namely, "The issuing by the Home Secretary of a warrant of search for Arcos and also the Trade Delegation, with a view to ascertaining whether the raid on the Trade Delegation was in harmony with the Anglo-Russian Trading Agreement of 1921."
§ Sir W. JOYNSON-HICKSMay I submit that this Motion is wrongly framed, as the warrant was not issued by myself? [HON. MEMBERS: "You authorised it!"] Further than that, I have stated that the Government are not in a position to arrive at a final decision, but that they will be able to announce their final decision on Tuesday next. That being so, there cannot be any possible question of urgency.
§ Lieut.-Commander KENWORTHYIn regard to this Russian organisation, for the first time in modern times we have had a raid by the police searching for a document. In this case, matters have gone very much further. Therefore, I put it to you, Mr. Speaker, that this does raise a matter of very urgent and definite public importance, because if the action of the Government be not challenged, other raids may take place on business houses in the City of London.
Sir F. HALLIs it not a perfectly easy matter for hon. Members to put down a Vote of Censure on the Government?
§ Mr. SPEAKERI am put in a position of some difficulty. I was prepared, if I had been asked, to allow a Motion for the Adjournment last Monday when the matter first came to the notice of the House, but, for certain reasons, it was not asked for on that occasion. It seems to me that the Chair would be put at a great disadvantage if the House proceeded to discuss a Motion in regard to which the facts are not wholly before hon. Members. I hope the House will be able to come to some arrangement which will not put me in that position.
§ The PRIME MINISTERWould it help if I made the suggestion that we should raise no objection if the Leader of the Opposition would move the Adjournment of the House on Tuesday?
§ Mr. SPEAKERI think I ought to point out that on Tuesday we shall be working on the time-table, and that Motion could only come on at the end of the other business.
§ Mr. CLYNESMay I submit that the Prime Minister entirely overlooks what is the right of the Opposition in regard to such a matter, namely, to frame its own Resolution, after we have heard the statement of the Home Secretary on this question, which has been promised for Tuesday.
§ The PRIME MINISTERThere is no inherent right in the Opposition to frame their own Resolution, unless they do so in the form of a Vote of Censure.
§ Mr. CLYNESIf there be no question of a right in this matter, will the Prime Minister leave the Opposition free to frame the Resolution as they think fit?
§ 4.0 p.m.
§ The PRIME MINISTERI do not quite understand what the right hon. Gentleman means. The Opposition is always perfectly free to frame a Vote of Censure in any terms it likes, but if it is a Resolution, or the discussion of any subject which does not involve a Vote of Censure, then they have no right to do that. The Government offer them a whole Supply day on which the matter can be discussed, in conformity with the usual and age-long precedent in this House, for a whole day. The only point about that is that, when a matter is discussed on Supply, you do it by moving a reduction of the Vote, and not by putting down a Resolution.
§ Mr. CLYNESThe fact is that there is more than one Department involved. There are three Departments specifically involved. This, we understand—indeed, we have been informed—is a deliberate act of Government policy which has been the subject of recent Cabinet discussions and decisions. We have been promised a day for the discussion. We await the Home Secretary's information on Tuesday, and I submit that, in such circumstances, the Opposition is entitled to full freedom in the framing of its Resolution after it has heard that statement.
§ The PRIME MINISTERIf that be the difficulty—which I quite see—I feel confident that, in the circumstances, whichever Vote was put down, the Chairman would allow—at least I hope he would—a discussion covering the whole ground.
§ Mr. HENDERSONI appeal to you, Mr. Speaker, in view of the statement made about the undertaking given to me by the Home Secretary, on conversations opened up by himself, and subsequently approved by the Prime Minister. To take part of the time to which the Opposition is entitled under the Orders of the House, is not giving us anything at all. I appeal to you as to whether that is carrying out the undertaking that has been entered into.
§ Mr. SPEAKERThat is not a matter on which I ought to express an opinion. It might, possibly, help the House if I said that I have frequently seen tabled Motions which the Opposition did not characterise as Votes of Censure, but the Government took them as Votes of Censure. There must be some criticism of a 1377 Government in the Motion, unless the Opposition is going to move a vote of approval. It seems to me the two sides are not very far apart.
§ Mr. CLYNESInterpreting that statement in the light of what has happened on previous occasions, I can only say that the Opposition will put down its Motion and have the discussion on the Thursday.
