asked Her Majesty's Government:

Whether they are aware of any case in this country in which use has been made of the defence of development risks for which provision was made in Section (4)(1)(e) of the Consumer Protection Act 1987.

Her Majesty's Government are not aware of any case in which the defence provided in Section 4(1)(e) of the Consumer Protection Act 1987, the development risks defence, has been invoked.

asked Her Majesty's Government:

Whether they are aware of any case in any other European Union member state in which use has been made of the defence of development risks for which provision was made in the 1985 European Commission Directive on Product Liability.

Lord Fraser of Carmyllie

Her Majesty's Government are not aware of any case in other member states in which the development risks defence, for which provision was made in Article 7(e) of the EC Directive on Product Liability (85/374/EEC), has been invoked.
