HL Deb 15 June 1990 vol 520 c591WA
Lord Denning

asked Her Majesty's Government:

Following the answer of the Lord Chancellor on 27th July 1989 (H.L. Deb., col. 1670) whether, in the case of Church of England Schools founded in Victorian times under the common form of words in the trust deed, the beneficiaries were a class of the poor of the parish and the area of benefit was the parish iteself.

The Lord Chancellor (Lord Mackay of Clashfern)

The noble Lord's question raises a matter of law which can only be answered by the court which is asked to construe a particular trust deed of this kind.
