asked Her Majesty's Government:

Whether, on a charge of causing death by driving a motor vehicle recklessly, it is proper for the Crown Prosecution Service to call or tender or offer in evidence, as a witness to the speed of the vehicle, an expert engineer (who was not present) whose report was based on witness statements taken after the accident by the police (who were not present) and on the expert's own inferences therefrom as to the height and distance the body was thrown and his own mathematical calculations therefrom.

It is for prosecuting counsel exercising his profesional judgment to select from the relevant and admissible evidence that which is to be adduced on behalf of the Crown in any particular case. In certain circumstances the trial judge may himself direct the calling of witnesses.
