asked Her Majesty's Government:

Whether, following the Lord Chancellor's Answer of 7th November [HL Deb. col. 700], the Crown, as parens patriae representing the beneficial interest in a charity, accept the view of the Charity Commissioners that they can make an order for sale of charity property under Section 29 of the Charities Act 1960 independently of Section 23 and free of any provisions, conditions or limitations which would have applied if they had made the order for sale of the self-same property under Section 23 instead of Section 29.

Section 29 of the Charities Act 1960 prohibits the sale of permanently endowed charity land without an order of the court or the Charity Commissioners and enables the Commissioners to make orders permitting the sale of such land.
