17. Mr. McAvoy

To ask the Secretary of State for Social Services what study his Department has made of the extent to which local social services authorities are implementing section 2 of the Chronically Sick and Disabled Persons Act; and if he will make a statement.

Mr. Scott

The Department receives regular returns on many services provided under section 2 of the 1970 Act, as well as information from the Social Services Inspectorate. But it is local authorities which are responsible for implementing the Act.

To ask the Secretary of State for Social Services when the Minister for Social Security and the Disabled last met the organisations of and for disabled people to discuss the extent to which local authorities are implementing section 2 of the Chronically Sick a:nd Disabled Persons Act.

To ask the Secretary of State for Social Services if he will meet the organisations of, and for, disabled people to discuss the implementation by local authorities of sections 1 and 2 of the Chronically Sick and Disabled Persons Act.

Mr. Scott

I frequently meet organisations of and for disabled people but I have not recently been asked for a meeting specifically about implementation of sections 1 and 2 of the Chronically Sick and Disabled Persons Act. The Department receives regular returns on certain services provided by local authorities under the Act as well as informtion from other sources including the Social Services Inspectorate. We have received no evidence that local authorities are generally failing to undertake their responsibilities under sections 1 and 2 of the Act. We do, however, follow up any specific cases referred to the Department where it was alleged that a local authority is in breach of its statutory duty.
