§ Lord Aveburyasked Her Majesty's Government:
Whether EEC nationals who are studying in public or private institutions in the United Kingdom 1002WA are deemed to be exercising their rights to the receipt of services as provided by Community Law.
§ The Earl of SwintonStudents attending universities, public sector higher education or non profit-making institutions would not be deemed to be exercising any rights conferred by the provision in Article 59 of the Treaty of Rome relating to the freedom to provide services. This is because Article 60 provides that services shall only be considered to be services within the meaning of the treaty where they are normally provided for remuneration. Certain rights would, however, be obtained in the case of students attending commercial institutions.
