§ 15. Mr. Alfred Morrisasked the Secretary of State for Social Services if he will set out the circumstances in which he would be prepared to use his default powers in respect of the provision of services under section 2 of the Chronically Sick and Disabled Persons Act 1970.
§ Mr. NewtonMy right hon. Friend may use these powers only where he is satisfied that a local authority has failed to discharge a statutory function. Whenever such failure is alleged a full inquiry is made and each case is considered in the light of the evidence obtained.
